Since you got your H1B approved, it is risky to take another chance with lottery. With the approved H1B you can transfer it. In the meantime from this time till October you can get your OPT extended but you have do it within 30 days of receiving your H1 notice. Dont worry, you are not out of status. Look out for a job now.

Recently I filed FOIA for the complete set of documents on my I-485, becaz my employer didnt share any documents with me.
Now I got my I-140 application and Receipt Notice and all the documents submitted for I-485, but there is no I-140 approval notice, is anyone out there filed FOIA just to get the I-140 approval notice? or should I file I-824 to get the I-140 approval notice?

One of my ex-colleagues got his GC approved out of turn last year itself. He was EB3 - PD November 2005. They approved it for him, his wife and his two kids! He is a big devotee of Sathya Sai Baba and I think he certainly got his blessings on this one..!

I travelled to India first time after coming to USA. The airline people did not take my I94 from me. I was not aware if I had to turn it in. I came back and got another I94. Now what do I do with my old I94? My 140/485 is in progress.
Same thing happend with me too. I gave them, they said they don;t want.
I tried to give evey point of my transit, nobody took it.
Don't know how to handle.

yes, he is working for a desi company so he doesnot get paid when he's on bench. His last payroll ran on January 2009.

I brought toyota camry from a dealer in NY state last year feb/2010 on (toyota) finance, the dealer only asked me for my driver lience and ssn. he took copy of driver licence and ssn. nothing ask or talk about my immigration status etc, etc...
looking at me my friend (working with me) brought brand new toyota camry same month feb/2010 from PA dealer with 0% apr for 5 yrs. he also shown and given photo copy his driver licence and ssn.
myself and my friend both are on h1b visa.
this could be possibly happen because of private financing (toyota finance) not bank...

You are NOT eligible for AC21 benefits (for the part of continuing the GC even after jobchange) on your I140 yet . So technically if the job is different you need another LC and I140. But thinking from a broader view, LC states, job title, description, wage and employer. So from an LC point of view, as long as the stated conditions there remain the same, the job is the same. As long as the job is SAME no issues.

I could find this useful. I am in my 6th year expiring June 1, 2007. My employers are just about to file LC, so I guess being able to process I140 by premium will enable me file for a three year extension before my current stay expires.
May be they did it for those who are in 6th year and did not file LC 365 day before 6 year expiry.. Now they can file LC in perm get approval fast and then get Premium 140 to get 3 year extension on H1B.

Guys,
If one IV member moves from State A to B, what would be the process of transferring membership to state chapter?
Will it merely be a deleting datbase record from one state and adding it to another state? Or would it be again filling up survey to new state chapter..?

I feel that getting the EAD will give us more flexibility to survive in this economic condition as well as eligibility for spouse to work.

I got my H1b Renewed till July 2009 with a passport expiring in August 2006. I submitted my application in March 2006. So there is no issue relating to expiry of passport while applying for H1B.
Also as Krishna pointed out you can apply for a passport reneweal upto one year in advance. For stamping they require you passport to be valid 6 months after your visa expiry but again of you have more than one year left on your passport you can go to US consulate and explain the Indian policy they will stamp the visa on the same passport. Last year I got my H1b Stamped valid till July 2006 on a Passport expiring in August 2006.

If she plans to continue with her current employer after her travel, there is no harm in using AP. Once she comes back on AP, she automatically resumes her H1B status on the next H1B extension filing within US.
If she is OK with going through the hassles of visa stamping, that is fine too.
