I took some time to compile the list of INDIA only EB3 and EB2 categories for past 2 years and from the trend, it is very easy to predict the Oct bulletin.
It does not need a attorney or spies. You just need to work up the numbers.
I did this only for INDIA. Any chinese can complile it for China.

Begining of New year in Oct, they conservatively pull back the numbers so as to flush out pending apps.
Now since they have already flushed apps in June/July, in Nov they will move EB2 by six months and possibly either stop there or make it one full year by moving it by another six months.
For EB3, they like to get it stuck at mid year so Jun02.
Guys, give a thought to this trend and see if you can guess more accurately.

While today's development is great news for folks in the 485/AOS cue, what happens with people in CP? With the opening of the floodgates, I am unsure when visas will be available to CP cases who were scheduled for interviews in Aug and beyond. I am a great supporter of today's victory, but I am unsure where CP cases stand now? Another 4 year wait?

is it in any shape size or form possible that you would put your I-140 employer into a bracket of potentially fraudulent companies? or did you have sub labor? anything you can think of that your employer may not have toed the line as far as the law is concerned? i am not suggesting that fraud investigation is the cause of these happenings... i am in fact wondering if that could be the case... if you think your employers were super lawful, then who knows what USCIS is doing!!
Same thing happened to me. I had posted it last week. My VSC approved 140 got transferred to TSC last week and today got email that the case is now pending. 485 was orignally filed at VSC that got transfered to TSC in March 2007.

So, this would mean anyone stuck in name check should never receive FP--correct? I don't think that's the case...i know of a lot of people who get FP notices every 15 (or is it 18?) months or so and are stuck in name checks forever.
The two processes Name check & FP are parallel, not sequential.
I have myself not rcvd FP - July 2nd filer NSC-CSC-NSC transfer victim :-). My way of looking at things is that CSC transferred I-485 to NSC in late September. So my I-485 is queued after an August 17th filer. August 17th filers have rcvd their FPs recently (Bay Area, CA), so it should not be that far away. (BTW, I am not dying to get FP done, i just want to shorten my stay-alert-for-FP window and get it over with it)
USCIS works in strange ways...i may be using logic that's beyond their IQ :)

just exactly what ur case status says ...mine hasn't changed ever since it transferred to nebraska..it still says "the case has been transferred to NSC becoz they've jurisdiction over it etc. etc '

The maximum duration allowed on L1B is 5 years where as on L1A, it is 7 years. On H1B it is 6 years. Duration spent on L1 is counted with the duration spent on H1 and vice versa.
The maximum time allowed on H1B is 6 years, this includes the time you spent on L1. This is the reason why you have been given H1B that is only valid for 1 year.
On a side note, the maximum time allowed on L1 is 5 years - you had to go back to India since you have spent the maximum allowable time on that visa.
Now, there are two ways to extend your stay beyond the initial 5/6 yrs granted on H1 or L1 visas.
1. For both L1 and H1Bs: Go back to your country (India) for 1 yr after your initial term expires. After 1 yr stay in your home country, you will be eligible for "another cycle" of L1/H1. So, for L1 you will get another 5 yrs, and H1B another 6 yrs.
2. Another way to extend your H1B is to start your Green card process (file your labor, and then your 140). Once your labor is pending for > 1 yr, or your 140 is approved, you will be eligible for 1 yr or 3 yr H1B extensions. This does not apply to L1s.
Here is what I would suggest for your case:
Best case scenario: Wait until your 1 yr clock resets, apply for fresh L1A (multi national manager). Once you are in the USA, convince your company to file for your green card in EB1 - multi national manager. The EB1 is almost always current, you can get your GC pretty soon.
This is the best case scenario that I can envision for you.
Alternatively,you can come back immediately on H1, apply for your PERM and 140, and then get unlimited extensions based on your GC being pending.
You can also wait until your 1 yr clock resets and then enter on H1 in Feb 2008, where by you might be able to claim 5 more years on H1B extensions ( a total of fresh 6 yrs on your current H1B). eventually, you will have to file for your PERM and 140 and then get extensions beyond the 6 yrs. I think you will need to file a petition with USCIS indicating the H1B clock reset.
Merely applying for L1A will not invalidate your H1. however, entering on L1A will invalidate your H1b (you can only hold one visa at a time - L1 or H1B). BTW... I guess you can not enter on L1 until you reset your 1 yr clock.
If I were you,I would seriously consider entering on L1A and then filing for EB1 GC. This is the quickest possible route for your GC. Unless, ofcourse, you do not want to be with the company for another year or so because your relationship with the employer is strained.

Dear Member: As you know, the route of the rally on Sept 18th is from Washington Monument to Capitol Hill in downtown Washington DC. Please use the following advisory for travel to and from rally and related events. Everyone must arrive at the Washington Monument at around 9:00 AM on 18th. The march would begin at 11:00 AM and end at 12:30 PM. We will gather on Capitol Hill grounds and stay there from 12:30 thru 2:30 PM.

From Washing Dulles International Airport (IAD)
(1) Take the 5a bus from IAD at curb 2E to L'Enfant plaza Metro Station.
(2) Get down at the Rossyln Metro Station and Take the Blue line Metro towards Largo Town Center.
(3) Get down at Smithsonian Metro and Follow the Walking directions from Smithsonian listed above
From Baltimore Washington International Airport (BWI)
(1) Take the B30 Bus from BWI to GreenBelt Metro Station and get down at Green Belt Station.

(1) I-66 West becomes Theodore Roosevelt Memorial Bridge and becomes Route 50 East/ Constitution ave NW.
(2) Make a left on the 15th Street and go 0.5 miles South and arrive at the intersection of Independence ave and 15th street.
(3) Buses will drop off IV members at the intersection of 15th and Independence and will be parked at RFK stadium.
Points North and East
(1) From 295-S/Baltimore Washington Parkway take the US 50W/ Newyork Ave exit and go aprrox 5 miles
(2) Make a left on to I-395 S and go approx 2 miles
(3) Take the 12th St SW/Downtown exit and Make a left on Independence Ave with in 0.5 mile
(4) Arrive at the Independence ave and 15th street interesection in .5 miles. Buses will drop off IV members and will be parked at RFK Stadium
Departure Advisory
For people departing via WMATA Metro Rail/Bus
There are two Metro stations close to the US Capitol West lawn
(1) Union Station Metro on the Red line. (closer to west lawn by walk)
(2) Capitol South Metro on the Orange & Blue line.
Find out on what Metro Line (Blue/Orange/Red/Green/Yellow or Combination) your destination / Metro station is and chose either of the above Metro stations. Simply, Go to wmata website and get your itinerary. Your destination can be a Metro rail stop or some thing that is connected by both rail and bus.
Walking Directions to Union Station Metro Station
(1) Head North on 1st St NW towards Constitution ave approx 0.1 mile
(2) Make Right turn on Louisiana Ave to walk towards columbus circle approx .25 miles
(3) Cross the Columbus Circle to arrive at Union Station Metro.
Walking Directions to Capitol South Metro Station
(1) Head South on 1st st NW towards Independence ave, approx 0.1 mile
(2) Make Left turn on Independence avenue and walk East approx 0.2 miles
(3) Make a Right turn on New Jersey avenue and walk South approx 0.1 mile going past Cannon House building and C st SE
(4) Make a Left turn on D st SE and walk East approx 0.1 mile to arrive at US Capitol South Metro.
For People departing via IV Charter Buses
There is no pick up available around the US Capitol. IV Charter buses will be parked at the RFK Stadium which is accessible via METRO. The Metro stop is Armory Stadium which is on the Orange/Blue lines and is the 3rd stop from US Capitol South Metro. (Trains towards New Carrollton/ Largo Town Center)
(1) Follow the Walking directions to US Capitol South from the US Capitol West lawn as listed above
(2) Ride the Orange/Blue line to get down at the Armory/Stadium Metro stop.
(3) Walk towards Lot 7 from the Armory stadium. Street Signs will be available from the Metro station
(4) Board the bus and your Bus lead/Driver will get you to your destination

For people arriving at the Washington region airports (DCA/IAD/BWI) early morning Sep 18th
From Regan National Airport (DCA)
Regan National Airport is connected by WMATA Metro and is on both Yellow and Blue lines.
(1) Take the Blue line train (towards Largo Town Center) from DCA to Smithsonian to avoid transfers on the Metro.
(2) Use Walking directions from Smithsonian above to reach the Washington Monument grounds.
From Washing Dulles International Airport (IAD)
(1) Take the 5a bus from IAD at curb 2E to L'Enfant plaza Metro Station.
(2) Get down at the Rossyln Metro Station and Take the Blue line Metro towards Largo Town Center.
(3) Get down at Smithsonian Metro and Follow the Walking directions from Smithsonian listed above
From Baltimore Washington International Airport (BWI)
(1) Take the B30 Bus from BWI to GreenBelt Metro Station and get down at Green Belt Station.
(2) Take the Green line towards Branch Ave and get down at L'Enfant plaza Metro Station.
(3) Take the Blue line towards Franconia/Springfield Metro and get down at the Smithsonian Metro
(4) Follow walking directions from Smithsonian as listed above.
For people arriving on buses (ONLY IV Charter Buses) points south and west
Points South
(1) On I-395 North/George Mason Memorial Bridge,Stay in the 2 left lanes and follow directions to US-1/Downtown. (approx 1 mile on Route 1)
(2)Route 1 becomes 14th St SW.
(3) Make a left on Independence Ave and arrive at the intersection of 15th and Independence Ave.
(4) Buses will drop off IV members at the intersection of 15th and Independence and will be parked at RFK stadium.
Points West
(1) I-66 West becomes Theodore Roosevelt Memorial Bridge and becomes Route 50 East/ Constitution ave NW.
(2) Make a left on the 15th Street and go 0.5 miles South and arrive at the intersection of Independence ave and 15th street.
(3) Buses will drop off IV members at the intersection of 15th and Independence and will be parked at RFK stadium.
Points North and East
(1) From 295-S/Baltimore Washington Parkway take the US 50W/ Newyork Ave exit and go aprrox 5 miles
(2) Make a left on to I-395 S and go approx 2 miles
(3) Take the 12th St SW/Downtown exit and Make a left on Independence Ave with in 0.5 mile
(4) Arrive at the Independence ave and 15th street interesection in .5 miles. Buses will drop off IV members and will be parked at RFK Stadium
Departure Advisory
For people departing via WMATA Metro Rail/Bus
There are two Metro stations close to the US Capitol West lawn
(1) Union Station Metro on the Red line. (closer to west lawn by walk)
(2) Capitol South Metro on the Orange & Blue line.
Find out on what Metro Line (Blue/Orange/Red/Green/Yellow or Combination) your destination / Metro station is and chose either of the above Metro stations. Simply, Go to wmata website and get your itinerary. Your destination can be a Metro rail stop or some thing that is connected by both rail and bus.
Walking Directions to Union Station Metro Station
(1) Head North on 1st St NW towards Constitution ave approx 0.1 mile
(2) Make Right turn on Louisiana Ave to walk towards columbus circle approx .25 miles
(3) Cross the Columbus Circle to arrive at Union Station Metro.
Walking Directions to Capitol South Metro Station
(1) Head South on 1st st NW towards Independence ave, approx 0.1 mile
(2) Make Left turn on Independence avenue and walk East approx 0.2 miles
(3) Make a Right turn on New Jersey avenue and walk South approx 0.1 mile going past Cannon House building and C st SE
(4) Make a Left turn on D st SE and walk East approx 0.1 mile to arrive at US Capitol South Metro.
For People departing via IV Charter Buses
There is no pick up available around the US Capitol. IV Charter buses will be parked at the RFK Stadium which is accessible via METRO. The Metro stop is Armory Stadium which is on the Orange/Blue lines and is the 3rd stop from US Capitol South Metro. (Trains towards New Carrollton/ Largo Town Center)
(1) Follow the Walking directions to US Capitol South from the US Capitol West lawn as listed above
(2) Ride the Orange/Blue line to get down at the Armory/Stadium Metro stop.
(3) Walk towards Lot 7 from the Armory stadium. Street Signs will be available from the Metro station
(4) Board the bus and your Bus lead/Driver will get you to your destination
Please make sure that you have the bus lead(s) phone number and there will be a roll call before the bus departs. For exact timings of departure, please talk to your bus lead.

My PD is Nov 2005 , I had I-485 interview in Feb 2009, because dates werent current I was given a letter saying "Your case has been continued because of VISA unavailability"
My question is if I claim unemployment insurance would I have issues in GC adjucation? ( Since my case is already pre-adjucated)?

Just had an infopass appointment.
Me: Can you tell us the status of our 485s?
I/O: Name checks are pending for both
Me: Do you know when they were started?
I/O: At the time your application was submitted (duh!)
Me: Would our applications still be processed?
I/O: Yes, they are at TSC(duh!) and they are aware of the 6 month rule
Me: Are they assigned to an officer?
I/O: Right now they are with the officer"s" at Texas, as recently as July 31st, not too long ago.
Me: When do our fingerprints expire?
I/O: blank
I had enough by then.. dont think anything will happen to our apps this month. My wife will get a RFE, because of incomplete medicals (Xray), I was atleast hoping to get that RFE this month.

Hi all
I am a green card holder. I received my green card through an application filed by a former employer, and received it in September 2004. I got married in Arpil 2006, my wife is from my home country, she had been in the US previously on an F-1 status which has since ran out. She became pregnant soon after we were married. She came up to the US last September on a B visa. She was given 6 months stay on her I-94; and had the baby here in January of 2007. Her expiration date on the I-94 is in 3 weeks and she is going to leave (with the baby) to maintain good status standing.
I filed for her (I-130) last July. Our plan at this time is for her to go to grad school, apply for a new F-1 to come back here. We are presently waiting for a decsion on the grad school application from the school she applied to.
I hope this isnt too confusing, but can anyone offer any suggestions or help with our situation? In terms of what options are out there for my wife to be here with me if things dont work out with grad school/ F-1 visa? As I mentioned I did file for her, but as I am not a citizen it will take longer. Also our newborn baby is a US citizen as she was born here.

RD: Jul 11th

EAD expiring on Oct 3rd.So my countdown started.
This is scary man...
our expiration date is the same as yours Oct 3rd. I dont wanna scare you but we e-filed @ TSC on June 8, had our FP July 8 and I-485 is pending @ TSC. It still took 67 days to get CPO e-mail on 8/14 and we finally got our cards 8/20. So altogether 73 or so days.

I believe you should be ok since you are travelling and returning before expiry of old AP. You should be physically present in the US during application of new AP. Once you have the receipt for new AP, you should be good to go.

Joey, I like the last one with 2 suggestions. 1) As Josh suggested, get rid of the birds and retake it when the shadows are a bit less imposing. 2) Stage a foreground object. The path is too bland, and needs an anchor or point of interest. It doesn't have to be large. A park bench, a log beside the path, a small shrub near the path, for example, maybe even a blanket with a picnic basket on it. Not sure it would blend in, but maybe even a (subdued) hopscotch layout in chalk on the path. That would establish your "near". I like the "far" in this shot. At first, far appears to be straight down the path. But then you realize that far actually bends behind those smal trees to the left of the path, and the furtherst point ends up between those and the large single tree. I found my eyes taking a nice journey in those directions. Just a few thoughts.

Couldn't resist opening a new thread and sharing this with fellow IVians.
We got our green cards today. It is actually green (in the back).
Another announcement is that I recently relocated to northern Mississippi. Would like to join up with other state chapter members. I am willing to coordinate with the group in Memphis TN.
Thanks IV. I and my spouse benefited a lot from the July 2007VB and the work IV did concerning it. So, I will do more than just stick around but continue to be active as usual. The system is still broken and we will have to work to fix it.
