I received my FP notice. My Lawyer also received my FP notice which he mailed it to me. Now I have two copies. Which copy should I carry for my FP appointment? Does it matter?

We should start somewhere to get heard. But again the media, government has too many other important issues to deal with and our issues may fall on deaf ears. We should still continue to make noise with a hope that we will get noticed.

Six years is the time you spent in USA. Not from the approval date. If you take vacation and go out from USA, you can deduct that period also.
You can try to stamp, if the H1B company give you a new job offer letter and other documentation. You must ready to answer the question about the delay in stamping.
No harm in trying. Or try to find another employer to file for H1B transfer, or with the same employer can file an amended petition with new start date and new salary offer, and after getting that approval, go for stamping.

As the visa runs for 6 years, would I be able to use it only till 2013 (6 years from 2007) or once I get it stamped this year (2010) , I can use it till 2016 ?
I heard that embassies scrutinize each case for fraud (although mine is based on real skills and job opportunities) I just want to avoid any issue with the stamping. I rather then go for a new visa if such a risk exists ( to avoid such an investigation or enquiry shadowing future prospects)
If it comes to me applying for a new visa, would I be subject to cap again or am I cap free as I have been counted earlier in 2007 ?

Can you tell me what your lawyer sent to the USCIS. How did he link the approved 140 to the pending 485. Did he fill any form? I am in the same boat. My both 140's are with the same company though.

My I485 application was approved aug 2nd and I got the card on aug 15th.
In the mean time my spouse application was also approved on aug 2nd but last week we got an email saying the card is returned undeliverable on aug 23rd.and aug 24th we got another email saying a notice was sent to the same address and that was also undelivered and there would be serious effects if the address is not updated.
We got our finger prints and everything in the same address and I am not sure why it was returned undeliverable.
Also I called the customer service on Aug23rd and 24th and updated the address.
any one in the same situation?

I think we may have spoken about this , but here is my question :
My wife has her passpot with visa stamped till June 2007 from my previous company. She has a new I-94 extended till 2008 July. She will be going to India in March and will be back in May (before June 2007 expiry of the visa on her passport). Here are my questions :
1. Will at the port of entry she would get the June 2007 on her I-94 or the extension I-94 date of July 2008. I know it will depend on the POE officer, but I want to know what has been the experience of such cases...?
2. In case she gets June 2007 on the I-94 at POE, can I get it corrected at the local CBP office to July 2008 after she is home here in US? Remember it's not a mistake by the POE officer but he/she giving preference to visa stamp and not the extension paper ?

I've been in US for over a year on my L1b Visa. Last year i applied for my H1B visa and got through in the loottery. My Visa became effective Oct08. This question is arising a lot. It really should be asked of the Q&A session with the immigration lawyer. It clearly is figuring in the thoughts of a lot of members and if she is not sure she can perhaps clarify it through the AILA liason.
My understanding is that your 140 and its associated PD is protected only if you have filed 485 and are waiting 180 days. In cases where 485 is not filed, I believe you need the cooperation of the previous employer who has to leave that petition open until you get to the 140 stage with the subsequent employer at which point you could substitute the PD.
I know a few of the lawyers have said otherwise but I am not sure what their basis is for that. I think it needs some clarification. It may infact be so and that would be great but clearly with half baked knowledge in this era of massive retrogression it could turn out to be a painful mistake if the clock has to reset!

You are right.
For other folks, here is the summary -
1) Got H1B visa stamp valid from August 2007 till August 2010.
2) Started working from October 2007 and Was laid off in November 2007.
3) Joined a consultant (IT) in December 2007. Got the training but never pursued any job as did not like the IT field.
4) Found another job in my field (chemical engineering), filed for H1B (premium processing). Got approved without change of status in March 2008 (I-797B) .
6) Attorney said that i have an almost brand new H1B visa so don't have to get a new visa but have to bring myself back into status by re-entering into US. Did that in April 2008. Total number of out of status days = 134. Started working for this employer from April till 30 September 2008.
7) Found another job. Changed the job. Got the I-797A (with I-94). Working with them since October 2008. This new petition is valid from 1 October 2008 till 30 September 2011.
8) Came to New Delhi for visa stamping on 25th Feb 2010. Had almost 20 to 30 minutes long interview.
9) First VO asked normal questions such was job duties, salary, last 3 pay stub, W2 form etc.
10) Then VO found out from the form DS 160 that i have checked on 'out of status' checkbox. She asked what happened. I explained it.
11) She went to consult someone else. Came back and gave me back all the documents and asked that someone will call me on another counter.
12) Another lady called me on different counter after 30 minutes. She sounded friendly and gave me a 221 g form (pink). She told me that it will take 6 to 8 weeks to finish the admin processing.
13) 221 g form had questions like resume, thesis, publication, last 5 travels in US etc.
14) I asked the lady if i can go back on my current valid visa and new I-797A. She went to consult with someone else and said that yes i can go back if i want to and the embassy will shoot me an email when they need the passport for visa stamping.
15) With my best judgment, I left India for US on 3rd March 2010. At POE (Chicago), forwarded my passport (work visa valid till August 2010) with the I-797 A (valid till September 2011). CBP officer gave me the I-94 valid till September 2011.
16) On 16th March 2010, got an email from embassy that they need my passport.
17) I asked if they have received the clearance. They sent me back the automated message that they need my passport.
18) Called DOS to know the status. They said that they can only see on their system the information submitted by the embassy and not beyond that. And the latest information embassy submitted was that they need my passport. The also mentioned that they don't have any idea why the embassy needs my passport. And 221 g is not cleared yet.
19) With best of my abilities, made a decision to go back to India and submit the passport to vfs.
20) Came to India on 29th March 2010 (early AM) and submitted the passport on the same day.
21) Passport was sent back to me on 1st April 2010 with the visa stamped.
22) The new Visa expiration date is 29th March 2012 while I-797A expiration date is September 2011. Why is it so i do not know.
23) Checked the status on the New Delhi embassy website for 221g and it still says that the case is pending though i have received the visa stamp. It indicates that embassy folks do not update the case status report for 221 g.

I don't think it happens automatically. You will need to ask to be accorded the earlier priority date or if interfiling you will also initiate the process by asking that USCIS substitutes the previously submitted I-140 with a new approved one. The time to do that is when the PD on the newly approved 140 becomes current.
From your explanation, now that your old PD is current and the 140 for that is approved, you will have to ask that interfiling occur by sending a letter to USCIS with a copy of the new 140.
If you have done this, then the message you got could be that USCIS is ready to review your file by October. A congratulation may be in order here because I believe you will soon get your GC.

Your visa will be stamped for the required period - IRRESPECTIVE of your Passport expiry (the only condition being that your passport should be valid for the next 6 months).
Upon expiry of your passort - you can travel with your renewed (or new booklet passport), though your US Visa remains in the old passport.
You will need to carry BOTH your old passport (with the US Visa) and the new one, anytime you travel in and out of the US.

Get a non-availability certificate from the local municipal office and submit it to USCIS..on a safer side..

Or get the birth cert from Indian Embassy in US... They'll issue it based on her passport..

The summer August recess is in progress and the lawmakers are still in their constituencies. This is an opportunity for us to meet with them and address our issues and present solutions in preparation for the upcoming CIR. We must push for our agenda to get our provisions in the base bill as CIR is being drafted currently. If we do not get our provisions in the base bill then it is much harder to get them attached to the bill in the form of amendments.
IV therefore requests its members, to continue to call up and start scheduling lawmaker meetings NOW. Please take appointments with your local lawmakers of both houses of Congress. In summary there are two parts to this action item
1) Please continue to take the appointments with your lawmakers. We need to maximize the remaining August recess days to get as many meetings as possible with either the lawmakers or their close aides. Once you take the appointment, update the details in the Lawmaker Appointment Book that is available on http://immigrationvoice.org/index.php?option=com_content&task=view&id=80&Itemi d=36 and you will receive the Advocacy Packet that you will need to take to the meetings.
2) Once you have your meetings, please email the details and feedback to info@immigrationvoice.org to help us follow up with their DC office with your feedback. Your detailed feedback will also help other members in their upcoming meetings with their representatives.
We must push ourselves harder and stronger in this month if we have to see the light at the end of the tunnel. Advocacy is an integral, essential and important part of democracy and we must exercise our first amendment right. We not only are highly skilled and are high income individuals that but we are truly the best and the brightest Future Americans that contribute significantly to the progress of America.

IV = I+We : The Importance of Grass-Roots Organization
Immigration Voice is a grassroots organization, which means, every member in the community plays an important role towards resolving our issues and achieving our goals. Our members are highly skilled, well educated and extremely talented who continue to contribute towards the success of the organization. Our membership base is large and growing every day. The best way to organize ourselves so that our efforts can be effective and yield desired results is by joining state chapters and actively participating in grassroots efforts. State chapters play a very important role in shaping the organization. State chapters organize conference calls, meetings, social gatherings, grassroots advocacy, publicity campaigns, and media campaigns, generate awareness and coordinate many other activities. State chapters also train and mentor members and organize meetings with local lawmakers to discuss our issues, which is the most important aspect of grassroots advocacy. When more people meet with local lawmakers of their constituency and apprise them of our issues, the better will be their understanding of our issues and goes a long way towards aiding our ongoing advocacy efforts. Voicing our opinions and concerns in a peaceful manner is the �American way� of doing things and Immigration Voice is the platform for future Americans like us to voice our opinions and concerns.
State chapters organize workshops, participate in community events like fairs and marathons, and help arrange media interviews, organize advocacy events like lawmaker meets and rallies, help in raising funds towards advocacy and running the organization. State Chapter members are always verified by the chapter leaders. Most often, the core team shares updates with chapter leaders who in turn share these updates with the chapter members. Chapter leaders keep the members of their state involved, recruit more members and help organize activities and events. Besides joining and participating in state chapters, we need other active volunteers to join us in different teams which are working in specific area like the media group, the newsletter group, the advocacy group etc. Each of these groups is led by dedicated members who work with members in formulating IV documents and strategies.
We also want to urge our members to generously contribute to our cause. We as a non-profit organization depend on your contributions to work on various media and advocacy activities.
