Question:
I filed my i 140 and i 485 on Dec 23rd 2003 under EB3 category. I think my labor was filed under EB3 category. My Priority date is Mid August 2003. After 180 days of filing (around Nov 2004) I left my sponsoring company and joined another company with similar Job responsibility (to avail AC21), But didn't get my H1b transferred to new company. My new job require Master degree and 5 years of experience. I have acquired my master degree before joining my new company. I got married recently and Ofcourse I can't file for my wife's i 485 since I am from India and visa numbers are not available.
Can I get my H1Bvisa transferred to new employer if he is willing to sponsor?
Can I file another i 485 under EB2 as my new job requires Master degree?

How come they cannot consider my EAD, Official transcripts, Graduate status letter?
Regarding Status letter, I have seen students applying like this and getting query later. What do you say about the students graduating in May (who files like me with OPT card and status letter) and applying for H1 in April?
You can postpone your graduation but you need to have completed all your credit hours and thesis work if any before you can apply on the master's degree quota. That is what people use their status letters for, to tell the USCIS that they have completed all degree requirements but will graduate later. In your case, since you haven't finished your degree requirements and will not do so by the time you apply for your H1B, the status letter is of no use.

I have seen people talking about getting approvals with misdemeanors, but each case may be different. Murthy.com forums has a special section for people dealing with misdemeanor issues and have gone through the process, may be you will get some more tips about preparing for the interview there. Bachelors+5yrs is also fine for EB2----- As per my lawyer at the time of my filing....EB2 requires either MS or BS+yrs.....
I agree with the earlier post....look at how it was advertized.....in my case, we did only MS since I had MS and did not have 5 yrs then...so the advertisement said only MS as requirement....
If your advertisement does not require MS, then this should be solved by a simple letter explaining the same......If by mistake it says only MS then the RFE is right in asking for MS certificate....however if the advertisement said either MS or BS+5 yrs ...you are covered......
Another important question is did you have 5 yrs when your labor was filed...becos that justifies ur EB2.....

Flash has it's own compression which it applies to any raster based graphics which are imported into it.. so, if you bring in a jpg or a png, or a ps doc, it will not add that much to the file. However png's and ps's will use up more processor power than the jpg's if they contain transparency and are located above another object, or are forced to move through tweening or a/s.

I485 along with EAD and AP applications filed during July 02 for me and my family. Got EAD and AP. Used Company�s attorney to file my applications. I live in Michigan and all documents send to TSC. My I-485 is pending with TSC.

How can I ensure that all communications from USCIS will be sent to me and not to the attorney? How the earlier G-28 forms we submitted will cease?
Do I need to submit my EAD and AP renewal applications to NSC? In other forums somebody suggested that it need to be filed at the service center where my I485 is pending.
Recently I had been to SSN office to get SSN# for my son (8 years). They refused to give SSN and asked me to get EAD for my son. When I questioned how EAD can be applied for a minor, they responded saying that I can apply EAD for minor and based on that EAD, SSN (not permitted to work) will be given to my son. Anybody got EAD for minors?

I'm in the same hole. Oct'2003 is my PD EB2I. had interview 3 months back. Was waiting so eagerly for this day. no update on my case. While I see Dec'2004 cases getting approved. Why can't USCIS do some organization and issue green card purely by priority dates rather than at the mercy of the officer. Why should they make lives of poor immigrants and green card applicants as miserable and touch as possible? Can't do anything more than feeling bad. :-(

Yes. If you are CP, you must intend to work for your sponsoring employer. That does not mean you need to work for that employer in India, but when you receive your GC, you have to work for the sponsor.
You can file an I-485 later if you wish, even if you are in the CP queue...if you enter the US in a way that permits AoS...that is, I don't think you can enter on a B1 tourist visa, then file AoS, but if you can get an H1b, you will be fine to file I-485.

But what happens if they send out FP notice and she doesn't do FP...it is going to be few years to get divorce as we have daughter...So i am pretty much sure i will get GC before we get divorce...At this point i cannot let USCIS know also because we are not yet divorced.
Since it looks like you are the primary applicant and your wife is the derivative beneficiary, I do not think your processing should be affected. I am not sure what you need to do to inform USCIS of your new status after you are divorced from your wife.

Well company A can file my GC but the issue is that the financial books of company A are not clear right now. Hence there are chances I-140 will be refused even if I file on EB1.
Company B is willing to take me but the issue is how do I join B. The options which I see are that B files my GC under EB2 or EB3 and I continue to work with company A till then. But then in EB2/EB3 the processing will take years till I get my EAD and join company B.
