Hi
My wife is on H4 and is planning to convert to F1 before joining graduate school to get scholarship. At same time my PERM is filed and once approved i was planning to use cross chargebility to file under my wife country of birth quota (UAE). i wanted to know following
a) if she applied for conversion for F1 today, can she get scholarship before she gets ssn or she has to wait till she gets ssn
The school cannot pay her stipend unless she has SSN. They might still be able to waive tuition, though.
B) If during her F1 processing time or grauate studies on F1, if my PERM gets approved, can i file for I-140 and I485 using cross chargebility with her being on F1 or i would have to wait for her to conert to H4? If there any risk to our green card processing
You can file I-140/I-485 while your wife is in F1. There is no risk to the green card processing. However, applying I-485 for her might end her F1 and put her into AOS (you need to ask lawyers for this; it is a bit unclear and I have seen contradictory responses).
C)If she continues on H4 visa, can she still get scholarship?
If the scholarship requires her to "work" (for example, being a teaching assistant or research assistant), then most probably no since persons with H4 are not allowed to "work". However, if the scholarship requires no "work", then she may be able to do so while being on H4.
I think the test is if she has to pay taxes for the scholarship money. If yes, then she cannot do so on H4, otherwise she may be able to do it.
if not once she graduates would she be in special US master degree quota for H1B?
Any help on these would be great
Thanks
Once she gets a master's from a US university, regardless of her status while she was in the university, after graduation she will be eligible for special H1-B quota (if it still existed that time).

How can you get original I-129? The petitoner submits that to BCIS. All you can have is a copy. Am I right?

Its been long since I got head ache..but today I had every reason to get.
I tried taking an appointment for h1B for December. Here is my experience
1. After entering the receipt details it took me to available dates calendar. In this screen there was no option to pick an specific date for appointment. This screen was same as the screen we get when we check for available date without entering receipt number.
2. I pressed Continue and it later took me to DS156.
3. Filled the form and it took me to screen which displayed my name against a check box with 3 option. The screen says..select the form to edit/complete.. 3 options I can see are DS156,DS157 and petition details. No matter how many times I edit the information I cant get the choice to pick the appointment date. Basically I have filled up the form without knowing the appointment date.
4. If I try to download the appointment letter it says..You cannot download until you specify courier address.
Has anyone experience similar problem?? Any work around.??
Any help is greatly appreciatedthanks in advance

I asked this before but did not get any answer. Trying my luck again. I lost my OPT card and unfortunately have no records what so ever of it.
Is there a way I can get a copy of this from USCIS?
USCIS will not give you a copy.
OK There are two places you can find your OPT CArd.
1. International Students Office of your College (if you had given thema copy, most likely).
2. The company that you were employed during OPT(Definitely they take a copy of this OPT Card. Check with them.)
Hope you will find Luck with this.

Always try to go for group policy with your employer, even if you are paying 100% of the premium and your company is not contributing a dime. That way your premiums are lower than what you get from the open market...may be you do not have that option but good to know... I can vouch for Kaiser, they are very good.
I was using my employers policy where I had $1000 deductible and paying $1100 per month (2adults+2kids).I switched to BCBS for personal insuracne with $5000 out of pocket limits with $435 premium/month. my calcualtion was I pay $5000 as monthly premiusms + $5000 max deductible -$1000per month just like I was with my employer. At least we can see some saving until we have to spend some amount on healthcare as deductible+outofpocket expenses. So far luck is with me and hoping it will continue.
But Again --these plans keep on increasing their price yearly --So I am also looking for good plan in Maryland. When I compared from ehealthinsuranne.com BCBS had better plans than Kaiser.but Kaiser seems to be public choice here.

WSJ is already pro skilled immigration and have had numerous articles on the same and keep having it all the time.
We can write to them to give it more PR. But a lot of readers of WSJ are very anti and all the comments are littered by that stuff. As a result, not sure if someone who reads the comments as well finds the articles helpful.

Means if we ask for AC21 then they ask for this kind of details? Also What is the Probability they ask for these details. Now I have 2 more questions:
1. if you are on H1 extension then you get new LCA at the time of H1 extension. If your current location and job are same as specified in the h1 extension LCA. (If you were working at wrong location at the time of first H1 but during the H1B extension you are working at the location specified in the LCA. Now how much is the possibility that they ask for the details for LCA Of the first H1B. Or tey look into only latest LCA).
2. One more question: If your LCA shows the city name LA but you are actually not specific in LA city but you are in LA county then is that location considered to be correct OR this is still violation?

This is a situation with my friend that I am posting under my name...
Questions are mostly related to regarding EAD situation
1. My friend is on H1 and have EAD (June'07 filer) for both him and his spouse... his spouse (secondary aplicant) is currently working on her EAD.. If his company lays him off... Would his wife have any effect on her employment?
2. Could he renew my EAD/AP on my own with no employer support (despite he has no job)
3. What if he goes to India on AP (or otherwise).. would that have effect on his wife's EAD/employment? If he goes to India on AP.. for how long could he go?
4. Could he take up any job and keep switching till priority date becomes current? Also what happens if and when priority date becomes current?
Thanks.
