Hi javans,

I am not an attorney, but I have seen people using 3 yrs of experience to count for 1 year of education. And EB2 category needs at least 5 years of experience in the job area in which you will be applying PERM.

Thus, 3 years of education + 3 yrs of exprience + 5 years of experience = EB2 category.

You will need an Expert letter for an accredited Evaluation to prove that 3 years of education+experience = 4 yrs of education.

I have myself not done it, but I have met few people in the past who did that.

And as far as second question goes, I have not heard anything like that at all. If you are inclined to do online course for one year, I suggest you to do Masters (1.5 years of education and .half year of research project).

I received my AP for the entire family thru' my lawyer and USCIS webpage is still showing that my 131 is in progress and case pending???
Hope it should not happen to the final GC!

1. I-131 EAD Application document



2. Copy of I-485 receipt notice
3. 2 colored passport pictures - recent
4. Cashiers cheque as stated in the form.

Send all this in and wait. You dont need an attorney to do this. This is really a simple procedure.

Is this common? Many friends who filed during the same time as me got

According to one website http://www.immigration-law.com the USCIS is working on trying to streamline processing I-140 petitions to four months by April 2009. I quote the following from the website

* This is a five-month old information which has just been released. This source of information indicates that the USCIS was hiring and training new employees and by April 2009, I-140 petitions might be processed in four months. It is a good news in a way.

Going by the previous track record of the USCIS though, I do have reasons to be skeptical about that. We will find out in April eventually, unless our invididual petitions get approved before that. The only issue is that in the interim we still have the threat to jobs in this bad economy. The other concern of mine is that older petitions might get dumped into another Backlog Elimination Center and they only work efficiently on newer I-140 petitions. That solution would be hell for people with older I-140 applications

That is the problem. There is no such thing in the flcdatacenter, but in onet online, there is a
15-1099.11 - Information Technology Project Managers. This is not present in flcdatacenter.

Here is the problem. So by this token, does it mean that IT Project managers either need to be classified as CIS managers or not get classified at all? This is absurd.

The attorney is not giving out any suggestions on what to do as they already filed, got a high PW and appealed which got denied.

The attorney is suggesting to refile, something I don't think is going to change the outcome.

Any suggestions?

This topic may be a bit counterproductive to what we've set to achieve as IVians but I hope folks see this in a true light. I could have set the title 'Return to Homeland', in my case its Return to India, hence the title.

I have been here for the past 9 years and as days progressed, my heart is back home. I may be closer than I ever was to get a GC but it seems I am to a point where I really want to give a shot to R2I. Reasons are several and are probably alike to several of yours. Family, Support and the whole other 9 yards..

That said, finding jobs back home while you are here in US seem not the easiest. I have seen a few in Google/Microsoft but I suppose there are many more. I am looking to return to Hyderabad. The reason why I am posting this here to is to seek help. If you or your friends work for companies that are looking for experienced managers to R2I, I would appreciate if you could post it here or PM me.

I am looking to R2I early next year but if the right opportunity comes along, I cud do it sooner than that. Thanks.

If I return to the US in a few months do I still have to option of filing 485 even though I've already applied for CP in India?

Yes to Q1. Yes to Q2, but you will have to discontinue the CP option. I would suggest going the CP way in your case. AOS is unpredictable with CP you will have a definite date. Best option get H1 in India return and apply for AOS, if not apply for CP and return with H1 go back in 6 months get GC if all else fails wait in India for 6 months and come back with GC.

I think was just in anxiety !!!. My wife recieved FP notice around 5 days after I recieved. We both have appointment on same day and same time.

So bottom line even though it is frustrating , I think the best solution is to just wait :)

Man you are in such a good position . I think with an approved I-140 in EB3 for Sep 2001 PD your GC should not be far away .. Don't mess around with it by changing it to EB2 or things like that. It might get complicated . I would say have patience for a few months . Once you get your GC you are free.

Using AC21 is not a bad idea for those whose GC is a distant dream but for you I think the goal is within sight.

I am a july 3 filer . I saw that there is on LUD with date of 11/25/2007 on my 140 which was approved on Jan 8,2007. My 485, EAD are still pending at NSC.

Can you guys tell me what that LUD on my 140 means?

I appreciate your help.
