    Hi,

    I'm in the US working on L1 visa, though I have an expired visa, I have I94 valid until Jun 2008 which makes me legal to work here until Jun 2008. Now, I'm planning to travel to India, Do I need transit visa in France if I travel via france.

    YES. French & British Airport needs a Transit Visa if your Visa Stamping on your passport is expired. If you have a valid 797 approval German airports let you in without a transit visa.

    First, get a new attorney and have him file G-28 for your 485, that way you'll control your 485, and also start the job hunt.

    I lost my job.My 140 is approved and I 485 is over 180 days.I have 2 yr EAD .I was laid off on 6 th April and I see LUD on I-485 on 9 april.I am so much worried that I may get RFE.
    What are my option if I get RFE on Employment before getting new job.How can I get my RFE from company lawyer becase Lawyer address is on my 485 Receipt.

    If you have an approved I-140, you can port the PD as long as your original sponsor does not withdraw his petition. Since your company is being acquired (as opposed to you quitting on your own) it is highly unlikely that your petition will be withdrawn. So as long as you continue doing a similar job as the one for which the LC position was advertised you should be fine.

    Thanks for a great forum. I am EB3 India (PD Dec 02) with 140 approved June this year. Rumor has it that the small firm I work for, is going to be acquired by a much larger firm with thousands of employees globally. I am concerned about my ongoing GC process. First question

    Q1. What happens to my GC process?

    Considering the behemoth like size of the company that is going to acquire us I am quite sure that the GC process of the few employees from my present employer will take a back seat.

    Q2. What are the things I can do proactively.

    I have read on various threads that it is possible to join other employers and port the PD to them. But considering the fact that company that started the GC process is no longer there, how would this porting of PD with new labor, 140 etc would occur...

    I would appreciate if someone can provide answers to my questions. Thanks for taking the time to read this.

    thanks munnabhai. I have read somewhere that if I/140 is approved and visa is unavailable then H1 can be extended for 3 yrs. Correct me if its not true.

    Eligible for 3 years if I140 is approved and you can't file I485 because of retrogression. But you said , you had already filed I485. I doubt you are eligible for 3 year extension.

    Thanks for your response. I'm leaning more towards Canada as I can avoid travel with my baby to India.
    Do you think they might reject the case for any reasons?
    How long do I have to stay in Canada if in case it's approved?

    if its approved I think you get it back the same day (that was back in 2007)

    if you get stuck in administrative processing it can take few weeks to months - check forums/threads on that topic

    As far as i know PF is controlled by the central government, TCS will not have any say in you withdrawing your money. Generally there is an upto 15% match from the company in your account, and that is yours the moment it is deposited in your account. You should not have any problems withdrawing your money. Your money is yours. Some companies deposit PF monies quarterly, small companies deposit it annually, in those cases you might be screwed if you company did not deposit the money in your account.

    techy,

    you misunderstood. we do not want unlimited EB visas. What is important here is clear the backlogs. we need to present a workable, feasible demand to the lawmakers to achive our goal. Already they have given so many provisions in the bill to overcome the backlogs in EB catagory. However, the only hurdle in thses bills are the hard country quota. Terefore we need to have a strong as well as simple demand. We should not ask so many small small demands. It wont help, inturn it may harm.

    By the way, I will be the most happiest person if they allow BS+5 years from numarical count in Eb2 catagory. I do not have MS and I have my 140 approved in EB2 with BS+5 yrs experience and I have nore than 10 years experience. But I still fell that this demand is too much.

    If we achive all the current provisions and removal of country quota, then it will be lottery to all Indians and Chinese.

    All that matters for the french is your stamping, if your passport stamping is valid(even if you are not on that visa anymore), you dont need. If your stamping expired, you need a transit visa, and you need to go in person for the french transit visa, which is not needed for german and british transit visa.


    Recently my parents went back to India via Fankfurt in Lufthansa.
    There they asked is your visa expired if so you should have transit visa.
    Since my parents had valid visa it was ok.

    I agree, and so just to vent, IV forum participation must be a give and take, it is shameful and unethical to ask questions and run away once its been answered or their problems are resolved, we have thousands of members and only a handful of them have contributed towards 2009 contributions, the total has not even touched $1500?? there is a limit to being a free rider, at times like these when legal immigration has hit bottom in the priorities list, cant we atleast pool some money and support those who are trying to work for us?? is it too much to ask? its just not enough to say "god will help us", god helps only those who help themselves.
    On the contrary I think IV forum can be stress relievers. One can share their pain, anxiety, news and questions with other people in the same boat.

    After your I-140 is approved, according to my lawyer, the PD is yours to keep. Even if they withdraw your I-140, you get to keep your PD.

    I talked to my lawyer in the morning today, and this is precisely what he told me.
