I could find this useful. I am in my 6th year expiring June 1, 2007. My employers are just about to file LC, so I guess being able to process I140 by premium will enable me file for a three year extension before my current stay expires.
May be they did it for those who are in 6th year and did not file LC 365 day before 6 year expiry.. Now they can file LC in perm get approval fast and then get Premium 140 to get 3 year extension on H1B.

What if you donot apply and you donot get EAD by Jan 08, you can still stay legally but wont be able to work without EAD.I will still be able to work if I have my H1B extension, right?
Check with your lawyer. Extension beyond 6 yrs is not available if you are eligible to apply for I485. If you are not able to apply for 485 because of retrogression, you can extend your H1 beyond 6 yrs (of course, it doesnt apply to you).Well, if I checked with the lawyer, I wouldn't be here, would I? :) I did not really understand your point. What if my I-140 is being processed and it takes them a hole lot of time for that and my legal status is expiring -- what am I supposed to do in that situation?

Did your wife get your back on to H4 visa from H1? What was the procedure that you went with? I also am on H1 in the US and want to move back to H4. I plan to go to mexico and re-enter the US with my previous H4, which is valid till mid 2010. Is there any problem at the port of entry?

A federal judge has ordered USCIS to pay attorney Kip Evan Steinberg $25,000 in legal fees after the lawyer's client sued the agency to force it to complete processing in an adjustment of status green card case. USCIS tried to point the finger at the FBI for delays in the name check process, but the judge wasn't buying. The judge found the 151 hours the lawyer put in to the case to be reasonable. I recently booked visa appointment at Chennai.

We are apply independently since both of us are in H1B status
I presume that this marriage in foreign country may not be valid because the marriage was neither registered in India nor done according to Foreign Marriage Act, 1969, since both of us are citizen of India at this present time.
However; we are working out with our parents to get married and register in India, but unsure when this will happen.

It is better to contact a attorney or other relavent family/marraiage law counsulars. It is very important. USCIS treats if vigorosly this issue, as marriage realted fraud is very high in immigration benefits, particularly in FB catagory.

How early can we apply for EAD before it expires? I know it is either of these: 180 days, 120 days or 90days ?

You can apply exactly 120 days early.
About my earlier post, You do need to send your papers such cutout from previous EAD, 485 receipt copy etc..

I know that it is possible to apply for H1-B visa and enter after using EAD. But, I am little dubious about using old visa after using EAD, but it should not make much of a difference I think.
In any case, you should be prepared to field questions at the POE for your actions otherwise he may ask you to use AP instead.
By the way, this is the only way one can re-instate their H1-B status after using EAD.

In that case, your divorce should not affect your I-485. You only need to make sure that you (or your lawyer) withdraw the I-485/EAD/AP for your wife.

Now, if I go for H1b stamping, lets say, in Nov 2006, will they stamp it till Mar 2007(my earlier extension date) or the new H1b approval, ie, Mar 2010.

You can only move after 6 months of 485 filing. Then it falls under AC21. Now if you move, you have to start the entire process. Fortunately with PERM and PP for 140, everything would take less than few months.
Hmmm, it happened to me and my company started new labor process through PERM. My second 140 is stuck for more than a year now.

You can keep your primary residence at the original labor filed location and convince your company to allow you to work at that place for six months at least once a week.

I called USCIS this afternoon and found that you can have information sent to a US consulate about your application.
When you call, select the option asks "are you calling about approved petition?", and then select the option that asks if you need to send the information about your petition to a US consulate. Since I was calling about some other app., I didn't go there. Perhaps you can give it a try.

My wife Volunteered at a day care, a school and the school that she is currently working before the school sponcered her H1 and hired her as a regular employee. We checked with the School HR ( Lawyer ) and our Lawyer before she worked as a volunteer at the school that she is currently working and neither objected.
There were no documents involved in the volunter work, I don't see how this could cause any issue.
Volunteer work done
Day Care --> 8 months
School --> 6 months
Current school --> 3 months
